1. Agreement to Terms

By accessing or using The Breakfast List ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of these Terms.

• You are responsible for safeguarding your password and any activities under your account
• You must be at least 13 years old to use this Service
• You may not use offensive, vulgar, or otherwise inappropriate usernames
• We reserve the right to refuse service or terminate accounts at our discretion

3. Content Submissions & Community Charts

Users may submit links and vote on content through our Charts feature. By submitting content, you agree that:

• You have the right to share the submitted URLs
• Your submissions do not violate any third-party rights or applicable laws
• You will not submit spam, malicious links, or inappropriate content
• You will not manipulate voting through automated means or multiple accounts
• We may remove any submission at our discretion without notice
• Submissions are public and may be featured in our daily publication

4. Prohibited Uses

You may not use the Service:

• For any unlawful purpose or to solicit unlawful activity
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information
• To upload or transmit viruses or any other type of malicious code
• To spam, phish, pharm, pretext, spider, crawl, or scrape
• To interfere with or circumvent the security features of the Service

5. Intellectual Property

The Service and its original content (excluding user submissions and third-party links), features, and functionality are owned by The Breakfast List and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Links and content submitted by users remain the property of their respective owners. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to display and distribute your submissions as part of the Service.

6. Voting & Charts

Our voting system operates on the following principles:

• One vote per submission per user (tracked by IP address)
• Duplicate URL submissions automatically upvote existing entries
• Charts reset daily at midnight ET
• We reserve the right to remove fraudulent votes or ban users who attempt to manipulate the system
• Top-voted content may be featured in the daily publication at editorial discretion

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free. We do not endorse or verify the accuracy of user-submitted content or external links.

8. Limitation of Liability

In no event shall The Breakfast List, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses resulting from your access to or use of or inability to access or use the Service.

9. Third-Party Links and Content

The Service contains links to third-party websites and content that are not owned or controlled by The Breakfast List. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by use of or reliance on such content available through such websites.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised terms.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
